| ARTICLE 1.0 - NAME OF THE BOARD | |||||||||
| The name of this organization shall be the KINGSTON AND DISTRICT BOARD OF APPROVED BASKETBALL OFFICIALS, hereafter referred to as KDBABO. | |||||||||
|
ARTICLE 2.0 - MEMBERSHIP AND AFFILIATION | |||||||||
|
The KDBABO shall be a member local board of the Ontario Association of Basketball Officials
(OABO). KDBABO members of the International Association of Approved Basketball Officials
(IAABO) shall be registered under the OABO, IAABO Board 102.
Through the OABO, the KDBABO shall be affiliated with members of the Canadian Association of Basketball Officials (CABO) and the Ontario Basketball Association (OBA), also known as Basketball Ontario. | |||||||||
|
ARTICLE 3.0 - PURPOSE OF THE BOARD | |||||||||
| The purpose of this board shall be: | |||||||||
| 3.1 | To organize the basketball officials of Kingston and District. | ||||||||
| 3.2 | To promote better basketball through better officiating. | ||||||||
| 3.3 | To consider helping, either financially or with a donation of services (or both), worthwhile causes in our community. | ||||||||
| 3.4 | To disseminate knowledge of the Official Rules of Basketball in order to bring about a standard interpretation of the rules throughout the area. | ||||||||
| 3.5 | To collaborate with other OABO, CABO and/or other local, provincial, national and international associations or organizations in achieving their ends. | ||||||||
|
ARTICLE 4.0 - MEMBERSHIP OF THE BOARD | |||||||||
| The membership of this Board shall fall into four categories: "active", "associate", non-officiating and "honourary life" members. | |||||||||
| 4.1 | Those eligible for active membership shall be all those who: | ||||||||
| 4.1.1 | Have tried Part 1 of the Official Examination under "open book" conditions. | ||||||||
| 4.1.2 | Have tried Part 2 of the Official Examination or IAABO Examination as set by the Technical Committee, under "examination" conditions before December 31st of any season, unless there are extenuating circumstances subject to the ruling of the Technical Committee. | ||||||||
| 4.1.3 | Have tried a minimum of two floor tests under observation of at least two different members of the Board's Technical Committee. | ||||||||
| 4.1.4 | Have paid an annual membership fee as set by the membership of: OABO CABO memberships local board fee, insurance, rule book, case book, and official's manual (plus, if requested, IAABO and or FIBA membership), which is not refundable and to be paid in full by two weeks prior to the provincial OABO payment deadline of October 31st; any increase in membership fees shall be assessed those members in or requesting membership in the applicable association. | ||||||||
| 4.1.5 | Have attended 60% of board meetings and clinics unless there are extenuating circumstances, determined by the Membership, that make the 60% attendance criteria impractical. | ||||||||
| 4.1.6 | A "dual member" is an active member who is not registered by the KDBABO with the OABO. Dual members must be registered with the OABO by their home Board and are expected to meet all listed eligibility criteria for an active KDBABO official. Officials seeking dual membership with the KDBABO shall apply for membership each year. | ||||||||
| 4.2 | That all non-transfer new members serve a probationary period of one (1) year. These officials would be under the direct supervision of the Technical Committee and be eligible for permanent active membership on the recommendation of the Technical Committee. The purpose is to evaluate new officials and identify if they have made any progress in this development. | ||||||||
| 4.2.1 | The board will accept applications for membership in September of each year. Applicants will include a CPIC report for the KDBABO upon application. | ||||||||
| 4.2.2 | The executive will determine if the board will be accepting any new members following a review of the number of returning members and the anticipated requirements of the board for the current season. This will be recommended to the membership at the second meeting for approval. | ||||||||
| 4.2.3 | Officials who move into the geographical area covered by the KDBABO shall be eligible for active membership as provided for under the OABO constitution. | ||||||||
| 4.2.4 | The following shall apply to any new member: | ||||||||
| 4.2.4.1 | Shall be subject to the terms and conditions of the Constitution and By- laws. | ||||||||
| 4.2.4.2 | Shall be a probationary member for a one-year period. | ||||||||
| 4.2.4.3 | Shall be under the direct supervision of the Technical Committee. | ||||||||
| 4.2.4.4 | Shall be advised as to the number of games and the level that they can expect to officiate at during their probationary period. | ||||||||
| 4.2.4.5 |
Having made observations and evaluations on the progress and
development made during the probationary period, the Technical
Committee shall make one of the following recommendations:
2. Eligible for full active membership. 3. Not eligible for membership. | ||||||||
| 4.2.4.6 | Probationary members who have been determined as not being eligible for membership shall have the reasons for this decision explained to them in writing. | ||||||||
| 4.2.4.7 | The decision of the Technical Committee, with respect to 4.2.4.5, shall be considered as being the position of the KDBABO that shall be final. Appeals to this decision shall not be considered. | ||||||||
| 4.3 | The Board may suspend or revoke the membership, or reject application for membership, of any individual who has participated in an action that is considered by the Board as being unethical, immoral or illegal. The Executive, on being made aware of any such conduct of a member, shall initiate a full investigation. The individual member shall be contacted as soon as possible to advise them of the allegations and to obtain his/her side of the issue. The Executive shall have the power to suspend the membership status of the individual pending the outcome of the investigation. The recommendations of the Executive shall be brought to the membership at the next general meeting of the Board. Revoking membership in the Board shall require a two-thirds (2/3) vote of the members in good standing present at the meeting. Any individual who has his/her membership revoked shall be informed by registered mail and have his/her KDBABO membership fees refunded. Decisions will be held in strict confidentiality. | ||||||||
| 4.3.1 | Those eligible for "associate" membership shall be all those who have paid the fee, but have not complied with the other requirements for "active" membership. | ||||||||
| 4.3.2 |
A member in good standing shall be defined as an active or associate member
that has attended 60% of Board meetings and clinics. Any member who is
under suspension shall not be considered as being in good standing. Members in good standing shall be eligible to: (B) Vote at the annual general meeting. | ||||||||
| 4.4 | A non-officiating member is a member who has previously registered as an OABO member but who no longer officiates games in any OABO board. | ||||||||
| 4.5 | Honourary life members shall be a person or persons nominated at the annual general meeting of the Board and approved for membership to the board in this status if approved by a vote of 2/3 in attendance. | ||||||||
| 4.5.1 | An honourary life membership can be bestowed up a past or current member of the Board (either "active", "associate" or "non-officiating") who has made significant contributions to the board over their careers as officials. | ||||||||
| 4.5.2 | Honourary life members of the KDBABO will not be required to pay membership fees. | ||||||||
| 4.6 | The Board shall reserve the right to award an Honourary Membership to any person who has made an outstanding contribution to basketball officiating. Honourary members may be asked to act in any capacity ex-officio. | ||||||||
| 4.7 | IAABO and the FIBA/CABO exams will be written individually under the conditions determined by the Technical Committee of the KDBABO. | ||||||||
| 4.8 | The members of the KDBABO shall be promoted or demoted by the Technical Committee based on floor observations, written or verbal evaluations and overall improvement or lack thereof. Written and/or verbal evaluations will be provided and each member may not appeal their status until the following September. The Executive will serve as the appeal body. | ||||||||
| 4.9 | Members may notify in writing the Executive of their desire to take up to one-year leave of absence and return as a member in good standing providing they held this position. Approval will be subject to review and decision by the Executive. | ||||||||
|
ARTICLE 5.0 - EXECUTIVE OFFICERS AND TECHNICAL COMMITTEE OF THE BOARD | |||||||||
|
The Executive Officers shall consist of:
President, Vice-President (Technical Committee Chairperson), Secretary-Treasurer and Convenor.

| 5.1 | The Executive Officers and/or Technical Committee shall be elected in the odd- numbered years at the AGM by current members in good standing. The term of office shall be for 2 years. The out-going President shall automatically fill the position of Past President. Should this individual not be available, a Member-at- Large shall be elected | ||||||||
| 5.2 | Should any member of the Executive and/or Technical Committee leave office for any reason in mid-term, elections shall be held at the next general meeting. | ||||||||
| 5.3 | If a member has cause to believe that any member of the Executive and/or Technical Committee is not performing duties in a manner in the best interests of the KDBABO, a vote of confidence shall be called immediately. If the vote of confidence shows that the Executive and/or Technical Committee member lacks support from the general membership (51%), a mid-term election shall take place. In the event that a majority of the Executive and/or Technical Committee is found to lack the confidence of the membership then a general election shall take place as soon as possible. | ||||||||
| 5.4 | The Executive and/or Technical Committee shall assume office following the Annual General Meeting (except in the case of a mid-term election). | ||||||||
|
ARTICLE 6.0 - DUTIES OF THE EXECUTIVE AND TECHNICAL COMMITTEE | |||||||||
| The duties of the Executive of this Board shall be as follows: | |||||||||
| 6.1 | The Past-President or Member-at-Large shall be an advisor to all ad hoc committees. | ||||||||
| 6.2 | The President shall: | ||||||||
| 6.2.1 | Call all general and executive meetings, arrange the agenda, and preside over those meetings. | ||||||||
| 6.2.2 | Be the official spokesperson for the Board in matters dealing with general interests of the Board. | ||||||||
| 6.2.3 | Have the power to cast the deciding vote on any matter when there is a tie vote. | ||||||||
| 6.2.4 | Be responsible for all press releases on behalf of the Board. | ||||||||
| 6.3 | The Technical Committee Chairperson shall: | ||||||||
| 6.3.1 | Be elected by the members of the Technical Committee. | ||||||||
| 6.3.2 | Assume the position of Vice-President and represent the Technical Committee on the Executive. | ||||||||
| 6.3.3 | In the capacity of Chairperson shall: | ||||||||
| 6.3.3.1 | Arrange for the writing of official examinations | ||||||||
| 6.3.3.2 | Co-ordinate floor tests by the Committee | ||||||||
| 6.3.3.3 | Arrange clinics for rule interpretations and floor mechanics and general game management | ||||||||
| 6.3.3.4 | Be the official interpreter of the Board | ||||||||
| 6.3.3.5 | Provide to the President a news release, pointing out rule changes and points of emphasis, in September and October to be submitted to the local sports editor of the local paper(s) | ||||||||
| 6.3.3.6 | Provide the Secretary-Treasurer with a copy of these news releases to be forwarded to all coaches and teams | ||||||||
| 6.3.3.7 | Prepare, with the assistance of the Secretary-Treasurer, an information bulletin to be forwarded to all Athletic Directors and League Convenors at the beginning of the season. It should contain a list of current members and their phone numbers, rule changes and points of emphasis for the upcoming season and the procedure to follow in the event that a coach wishes to write an official complaint regarding an official | ||||||||
| 6.3.3.8 | Maintain a current policy re: (1) what games and how they shall be assigned when there is a shortage of officials; (2) processing any coaches written complaints and; (3) the procedure to follow when assigning officials | ||||||||
| 6.3.3.9 | Ensure evaluation sheets for all officials are kept on file until the official is no longer a member. | ||||||||
| 6.3.3.10 | Have the authority to appoint panel members as evaluators to assist in the continuing evaluation of officials. | ||||||||
| 6.4 | The Secretary-Treasurer shall: | ||||||||
| 6.4.1 | With the President, be in charge of publicity for all meetings to each member of the Board and send written notification (and minutes of the previous meeting, where applicable) at least ten days prior to the meeting. | ||||||||
| 6.4.2 | Be in charge of membership generally, including the collecting of fees, the recording of names of all members, distribution of books and bulletins, etc. | ||||||||
| 6.4.3 | Shall ensure that the minutes of meetings are distributed to all members within two weeks of the meeting date. | ||||||||
| 6.4.4 | Shall ensure that the notices of meetings, clinics and examinations are distributed to all members two weeks prior to the date of such meetings or clinic. Distribution of notices for clinics and examinations shall be coordinated with the Technical Committee. | ||||||||
| 6.4.5 | Shall ensure that the board is in full compliance with the provisions set out in the OABO Constitution and any policies that may be established by the OABO. | ||||||||
| 6.4.6 | Record the proceedings and attendance of all meetings, and keep the permanent record of the minutes, which bi-annually will be handed over to the successor. | ||||||||
| 6.4.7 | Be in charge of all correspondence for the Board. | ||||||||
| 6.4.8 | Comply with 6.3.3.7. | ||||||||
| 6.4.9 | Maintain complete and accurate records of all Board finances. | ||||||||
| 6.4.10 | Along with another individual assigned by the Executive, conduct an internal audit of finances of the KDBABO and mail financial statement to membership. | ||||||||
| 6.4.11 | Prepare for the opening meeting of each season an operating budget for the membership's approval, which includes that year's membership fees to meet the approved budget. | ||||||||
| 6.4.12 | Be prepared to submit a report at each general meeting. | ||||||||
| 6.4.13 | Send the recommendations of the Technical Committee to all secondary school coaches re scheduling and how to handle complaints. | ||||||||
| 6.4.14 | Be exempt from paying all association fees. | ||||||||
| 6.4.15 | Submit a report in writing to all members at the Annual Meeting. | ||||||||
| 6.4.16 | Hold a bond from those returning members whom so desire and that have identified such within two weeks of the annual general meeting. This bond shall be applied to membership fees for the next season and shall be in an amount as set by the membership at the Annual Meeting. | ||||||||
| 6.4.17 | Be permitted to make any corrections and renumber articles where required. | ||||||||
| 6.5 | The Convenor shall: | ||||||||
| 6.5.1 | Be an active, associate or non-officiating member of the Board. He/she shall be under the direct supervision of the Technical Committee. | ||||||||
| 6.5.2 | Communicate with all convenors of leagues with which the Board is normally associated, as soon as possible after being elected. | ||||||||
| 6.5.3 | Assign only active and/or probationary members (as defined in Article 4.0) for all games within the jurisdiction of the Board without clearance of the Convenor of other jurisdictions. | ||||||||
| 6.5.4 | Be paid seven and one half percent (7.5%) of each member's earnings at the end of each month, or at the monthly meeting nearest this date. | ||||||||
| 6.5.5 | Submit a written report to all members 3 times per year: at the conclusion of the girl's high school schedule; and at the conclusion of the boys' high school schedule; and at the last meeting of the year, indicating the types of games officiated, i.e. midget, junior, senior, etc. and the total number of games for all members. | ||||||||
| 6.5.6 | Attend all member clinics and keep attendance records and apply Article 6.3. | ||||||||
| 6.6 | The Technical Committee shall: | ||||||||
| 6.6.1 | Elect a Chairperson, who shall serve as Vice-President and fulfill those duties listed in Article 6.3. The members of the Committee shall be responsible for assisting the Chairperson in carrying out those duties listed in Article 6.3 and those duties and responsibilities listed elsewhere in this Constitution and By- laws. The Committee may establish and assign specific areas of responsibility to individual Committee members. | ||||||||
| 6.6.2 | Observe and provide a written evaluation for all active members a minimum of two times during the season. | ||||||||
|
ARTICLE 7.0 – GENERAL MEETINGS OF THE BOARD | |||||||||
| General Meetings of the Board: | |||||||||
| 7.1 | Shall be held at least twice during the fall/winter season (September-December) and at least twice during the winter/spring season (January-May) or more often at the discretion of the Executive, with the date(s) to be set by agreement of the majority of the members. | ||||||||
| 7.2 | Are open to all members of the Board, league officials, coaches, and all interested in the promotion of basketball. | ||||||||
| 7.3 | Require regular attendance on the part of the members. Preference for assignments will be given to those officials attending regular meetings. | ||||||||
| 7.4 | Must adhere to the following order of business (Technical or Special Committee Meeting notwithstanding). | ||||||||

| 7.5 | The Annual General Meeting shall be held in May. | ||||||||
| 7.5.1 | At the AGM, a delegate(s) to the OABO AGM shall be nominated based on the current entitlement allowed under the OABO Constitution. | ||||||||
| 7.5.2 | The first delegate shall be a member of the Technical Committee with any additional delegates being nominated from the Executive of general membership. | ||||||||
| 7.6 | The first meeting of the season shall be held no later than the first week of October. At this meeting the delegate to the OABO Meeting shall be prepared to give their report in writing to all members of the Board. | ||||||||
|
ARTICLE 8.0 – CONSTITUTION AND BY-LAWS AMENDMENTS | |||||||||
| 8.1 | In order to bring about an amendment to this Constitution, a motion must be made, seconded, and passed by a majority of two thirds of the members in good standing at the AGM. Notice of such a motion must be made in writing to the Secretary-Treasurer three weeks prior to the meeting. The Secretary-Treasurer shall forward any motions to the members by mail at least one week prior to the AGM. | ||||||||
| 8.2 | By-laws may be amended at any regular meeting or AGM. Such change shall require a simple majority (51%) of the members in good standing. | ||||||||
| 8.3 | This constitution and by-laws shall be re-printed and distributed to all members in binder form before/at the first monthly general meeting following the Annual General Meeting. | ||||||||

BY-LAWS | |||||||||
| 1.0 |
Interpretation of the Constitution Decisions will be rendered by vote of the members of the Executive. | ||||||||
| 2.0 |
Absentee Voting May be arranged for only important items on the agenda of the Annual General Meeting. This will be in the form of authorization in writing to an eligible voter present at the meeting. | ||||||||
| 3.0 |
Minimum Age Requirement 17 years, except with the sanction of the Executive, for certain levels of competition. | ||||||||
| 4.0 |
Suspensions Any member who contravenes the requirements of the Constitution will be liable to suspension, at the discretion of the Executive. | ||||||||
| 5.0 |
Hearts and Flowers Fund The fund is to acknowledge special events in the lives of members. The fund will be used to provide suitable recognition for expressions of sympathy and births and special achievements etc. The Executive shall, on a yearly basis, set a fee for the fund. If there is a balance of $120.00 at the first fall meeting, then no fees will be collected for the year. | ||||||||

Reports on Unsportsmanlike Conduct Reports of unsportsmanlike conduct amongst players, coaches, officials and team followers should be directed to the Chairperson of the Technical Committee who in turn will direct an appropriate report to league officials. | ||||||||
| 7.0 |
Official's Dress All members must conform to the uniform as required by the KDBABO: Black trousers, socks and shoes, black and white V neck vertically striped shirt, with the appropriate board crest on the right arm, two inches from the shoulder seam. CABO crests may be worn on the left arm, two inches from the shoulder seam. IAABO crests may only be worn by officials registered as IAABO members, and then shall be placed on the left chest area. Special circumstances may require the wearing of a shirt different from the shirt described above (egg - Provincial Championship Tournaments, OUAA or OCAA mandated requirements where officials from other parts of the province are participating), but for all other games officiated by the KDBABO, the uniform used shall be as described above. Subsequent changes to the OABO Provincial constitution regarding uniforms shall apply only to those games at the provincial level, specifically governed by the OABO, and not to those games under the specific jurisdiction of the KDBABO. | ||||||||
| 7.1 | Members shall wear, as a warm-up jacket, a black basketball jacket. | ||||||||
| 8.0 |
Official's Duties The referee and umpire will be designated by the Convenor, and as much as possible, these major officials shall conduct the games in accordance with the appropriate rule set. All members of the Board shall adhere to the floor procedure as recommended provincially and by the Technical Committee at the clinics held after the Annual General Meeting. Any official who misses a game shall also report the incident to the Convenor. | ||||||||
| 8.1 | If any member cannot do his/her assigned game(s), he/she must inform the Convenor in order to keep accurate records for 6.5.4. | ||||||||
| 9.0 |

| 9.10 | The following travel rates are set for these areas: | ||||||||
| 9.10.1 | One travel shall be paid for any single game or double header. Where the same officials cover a triple-header, one travel shall be paid for every two games. This may be reduced where officials working games played at the same time travel together. | ||||||||

| The association may want to examine and adjust game fees and travel rates. | |||||||||
| 9.11 | When officials are assigned to a game(s), and upon arrival at the game it is discovered that the game(s) has been cancelled or rescheduled to an earlier start time, the officials will be paid the full game(s) fee plus all travel expenses where applicable. | ||||||||
| 9.12 | For secondary school and OBA tournaments, where games are reduced by at least 2 minutes per quarter or to 13 minute halves, the fee for each Official shall be $2.00 less than the normal fee per game, or shall be negotiable through the Technical Committee. Travel fees shall not be reduced. | ||||||||
| 9.13 | Where traveling involves overnight accommodation, the team arranging Officials shall pay for single room costs and meals. | ||||||||
| 9.14 | Where an Official fails to show up for a game(s) assigned, he/she will forfeit to the KDBABO Treasurer a fee of $35, payable before the next meeting. | ||||||||
| 9.15 | The Board strongly recommends that a separate dressing room be provided for Officials in regular season and in playoffs. | ||||||||
| 9.16 | The Board shall show a definite priority for the high school leagues in our area by not making seasonal commitment to calling high school games outside our area. If Officials are available on a game-to-game basis or week-to-week basis, the Convenor, in consultation with the Technical Committee, may assign Officials for the out of area request needs. | ||||||||
| 9.17 | When City League games are officiated, three officials may be assigned where possible and each official will be paid $25 per game for the 2003- 2004 season and $27 per game for the 2004-2005 season. | ||||||||
| 9.18 | Regarding withdrawal of services: Officiating services may be withdrawn from a league, a team, or a coach of a team, or a player on a team should conditions warrant. Initial action will be taken by the Executive and followed up at the next meeting of the Association. The terms of the withdrawal of services will vary with each situation and be decided by a majority vote of the members present. | ||||||||
